FEES & RATES

The regulation of tariffs

Because notaries perform a function in the public interest, remuneration for notarial services is strictly regulated and subject to predetermined tariffs. Customers are therefore guaranteed predictable and transparent remuneration.

A distinction must be made thereby between acts that are subject to regulated fees (sales, gifts, marriage contracts, inheritance, etc.), for which the notary receives a fee the rate for which is determined by law, and acts that are not subject to regulation, for which the notary is free to set his own rates.
For acts and services that are liberalised and not subject to regulated fees (advice, company law, business sales, property management and expert appraisals), the notary’s remuneration will be the subject of a fee agreement by joint consent with the client.

The fees charged in the notary’s office are set by French law as follows:
The rates were set by the decree of 8 March 1978 and have essentially been amended four times: by the decree of 16 May 2006, by the decree of 21 March 2007; by the decree of 17 February 2011 and finally by the decree of 26 February 2016; by the order of 26 February 2016 and the order of 28 October 2016 to meet the objectives of the Macron law of 6 August 2015 (in particular articles 50, 51 and 52 of its initial version under the chapter entitled “Conditions of practice of the regulated legal professions”). The regulated rates for notaries (known as emoluments) remain stable until 29 February 2020 (Order of 27 February 2018 setting the regulated rates for notaries).

Family law

  • Deed of notoriety: retainer of €350 inc.
  • Civil partnership agreement (PACS): retainer of €300 inc.
  • Marriage contract without any property contribution: retainer of €275 inc.
  • Donation between spouses: retainer of €390 inc.

  • Simple power of attorney: €80 incl. VAT (excluding Docusign fees)

Pre-contract of property sale

  • Pre-contract: €375 inc.

Condominium regulations

  • Condominium regulations and descriptive statement of division: €4,000 inc.
  • Amendment to the descriptive statement of division: €3,000 inc.

Company incorporation

  • Company articles of association: €3,000 inc.
